Arizona Sexting Laws


The Arizona state legislature recently passed a law to reform the penalties for “sexting”. Teens accused of willingly sending sexually explicit images to each other can be treated as a minor offense.

According to the Havasu News, under Senate Bill 1266, minors accused of willingly distributing sexual images or content will not face felony child pornography distribution charges.

Typically, it would be considered a petty offense, which is not even subject to arrest. A petty offense is considered lower than a criminal misdemeanor charge, and may only be subject to a citation.

Juveniles would not be subject to any charges or penalties if they were sent sexting images that they didn’t request or solicit.

And there is still the option of pursuing disorderly conduct charges or other offenses if the behavior appears to be egregious or deliberate.

The new law does not change any laws or penalties in cases where an adult is involved.
