Aggravated Assault Charge With No Physical Contact


This case is a great example of how you don’t even have to touch someone to be charged with assault in Arizona. People often think a fight or some kind of violent contact has to occur for an assault. This isn’t necessarily true as an El Mirage man is finding out.

Trinidad Delgado was looking for his cousin who owed him money when he walked into the residence of his cousin’s 26 year old girlfriend. He told the woman that he wanted his money. He returned a short time later carrying a shotgun.

According to this article from The Arizona Republic, he pointed the gun at the female and told her he would both knock her out and shoot her. He then left the residence before police arrived.

Police located Delgado at his home where he was arrested and now faces charges of aggravated assault, threatening, and trespassing. These charges are extremely serious crimes and Delgado would face a lengthy prison sentence if convicted on all three.

Aggravated Assault is the most serious assault crime in the Arizona laws. Delgado is charged with this offense even though he never touched the alleged victim. This is because aggravated assault can apply to threats made when the accused is in possession of a deadly weapon. Because he had a shotgun in his hand when he threatened the woman, he is looking at this Class 3 felony.

Threatening, on the other hand, is a far less serious but more common assault crime. If you threaten someone with physical harm or threaten their property you face Class 1 misdemeanor charges. In certain situations this offense can also be a felony, though it is not likely in the Delgado case.
