Arizona Woman Charged with DUI While Kids Ride Along
Being accused of drunk driving is serious enough. But being charged with a high BAC aggravated drunk driving offense offense with 2 preschoolers in the car is another level of criminal offense. According to the Arizona Republic, that’s just what Mesa police found last weekend, arrested a woman on a drunk driving offense with a 2 year old and 4 year old child in the back seat.
Thirty-eight year old Tonya Obarski of Queen Creek failed a field sobriety test and took a breathalyzer that showed her blood alcohol content to be .24, three times the legal limit. She is now charged with aggravated DUI.
What led to her arrest was a tip about a drunk driver. A police helicopter saw a van circling a parking lot seemingly confused about the location of the exit. Once exited, the police attempted to pull Obarski over but she continued for ½ mile before stopping.
There is no telling if this is Obarski’s 1st DUI or not. If it is she will face slightly more lenient penalties. Aggravated or Extreme DUI is applied when someone has more than twice the legal limit of alcohol in their body.
A first offense Extreme DUI is a Class 1 misdemeanor that carries 30 days to 6 months in jail. You will also be required to surrender your license, perform community service, pay fines, and complete a term of probation. Once your license is reinstated, an ignition interlock device will be placed on your car.
If this isn’t your 1st DUI and you face charges of Extreme DUI, the penalty is raised. You will face additional jail time, higher fines, and longer periods of license suspension.
